Short answer: You can put an ADU in many Florida backyards when your parcel sits in a jurisdiction that allows accessory dwellings, your setbacks and lot coverage work, and you permit a permanent foundation unit under the Florida Building Code. You usually cannot treat a tiny home on wheels (THOW) parked in a standard suburban driveway as a legal long-term ADU without a specific local exception.

Where backyard ADUs are most realistic today

City infill (by-right or streamlined):

  • City of Orlando — detached ADUs allowed by-right in many single-family zones when standards are met
  • Other municipalities are updating ADU ordinances—always pull current code text for your zoning district

Unincorporated counties (hearing path):

  • Orange County — often requires a Special Exception before permits
  • Rural counties may allow accessory structures on larger lots but still enforce septic, flood, and wind rules
