At a glance

  • Special Exception path. Detached ADUs with full kitchens often require a BZA hearing, neighbor notice, and public record—not staff-only zoning approval.
  • By-right (limited districts). Orange County Code §38-77 lists zoning districts where one ADU may be permitted by right; PD/PSP lots may still need plan amendments.
  • Owner Occupancy. Homestead on the primary dwelling is commonly required as a condition of approval—verify with county planning.
  • Parking. Typically one additional off-street space beyond what the primary dwelling requires.
